Welcome to Aplicart Creator. These Terms of Service ("Terms") govern your use of our platform and services. By accessing or using Aplicart Creator, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our services.

1. Overview

Aplicart Creator is a platform operated by Aplicart SLU that enables creators to monetize their Telegram communities through subscription-based access. Our services are designed to automate member management, payments, and access control for your Telegram channels.

2. Eligibility

By using Aplicart Creator, you represent that you are at least 18 years old and have the legal capacity to enter into a binding agreement. If you are using our services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3. Account Registration

To use Aplicart Creator, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Creator Responsibilities

As a creator using Aplicart Creator, you are responsible for:

• Ensuring that your content complies with all applicable laws and regulations.
• Managing your subscribers and providing the promised content or services.
• Setting your subscription pricing and handling any disputes with your subscribers.

5. Payment Processing

Aplicart Creator facilitates subscription payments between creators and their subscribers. Creators are responsible for setting their pricing and ensuring that their payment methods are properly configured. Aplicart Creator charges creators based on the selected plan:

• Starter Plan: Free with a 10% commission on subscriber payments.
• Pro Plan: €49 per month with a 3% commission on subscriber payments.

Commission fees are deducted automatically from subscriber payments before funds are transferred to the creator.

6. Price Changes

Price changes apply only to new subscribers. Existing subscribers will retain their original subscription price unless they choose to switch plans. Creators can offer flexible pricing, and members can upgrade or downgrade their plans at any time, except for lifetime deals. Billing adjustments are calculated automatically based on usage.

7. Content Guidelines

Creators must ensure that their content:

• Does not violate any laws or regulations.
• Does not infringe upon the rights of others.
• Is not harmful, offensive, or inappropriate.
• Does not include pornography, sexually explicit acts, adult content, or adult services, nor any material intended primarily for sexual gratification.

Aplicart Creator reserves the right to remove content or suspend accounts that violate these guidelines.

8. Termination

Aplicart Creator reserves the right to suspend or terminate your account at any time, with or without notice, for conduct that violates these Terms or is harmful to other users or the platform.

9. Disclaimers

Aplicart Creator provides its services "as is" and does not guarantee that the platform will be uninterrupted or error-free. We are not responsible for any losses resulting from your use of the platform.

10. Limitation of Liability

To the maximum extent permitted by law, Aplicart Creator shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the platform.

11. Changes to Terms

Aplicart Creator may update these Terms from time to time. We will notify you of significant changes by posting the new Terms on our website. Your continued use of the platform after such changes constitutes your acceptance of the new Terms.
